Terms of sale
1. Purpose
These terms of sale govern distance sales of jewellery by DILIP JINDAL PARIS ("we") to any non-professional buyer ("you") on dilipjindal.com. Placing an order implies full acceptance of these terms, in the version in force on the day of the order.
2. Seller
DILIP JINDAL PARIS, a French simplified joint-stock company (SAS) with a share capital of 1 000 €, registered with the Paris Trade and Companies Register under number 888 483 104, registered office 102 avenue des Champs-Élysées, 75008 Paris, France. EU VAT number: FR01888483104. Contact: contact@dilipjindal.com, +33 6 12 49 24 19. Atelier and shipping: 23 rue Claudot, 54000 Nancy, France.
3. Pieces
Each piece is designed and made by hand in the atelier, as a single example. Stones are natural: their colour, inclusions and dimensions may vary slightly from the photographs, which are as faithful as possible but not contractual. The essential characteristics of each piece (materials, stones, dimensions) are stated on its page.
4. Prices
Prices are shown in euros, inclusive of French VAT. Shipping costs are shown before you confirm the order. For deliveries outside the European Union, customs duties, import taxes and clearance fees are not included and remain payable by you (see our shipping policy). We may change our prices at any time; the applicable price is the one shown when you order.
5. Order
You select a piece, check your cart, enter your details and delivery address, then confirm the order by paying. The order is final when you receive our confirmation email. As every piece is unique, if a piece you ordered turned out to be unavailable (sold at the same time in a partner boutique, for instance), we would inform you without delay and refund you in full. We may refuse an order for a legitimate reason, such as a previous payment dispute.
6. Payment
Payment is due at the time of order, by card or by the other methods offered at checkout, through a secure platform. Your card details never pass through our servers. The piece remains our property until the price is paid in full.
7. Delivery
We deliver worldwide. Orders are prepared in the atelier and handed to the carrier within 3 working days of payment; indicative delivery times by zone are detailed in our shipping policy. Every parcel is tracked and signed for on delivery. The risk of loss or damage passes to you when you, or a third party designated by you, take physical possession of the piece. Check the piece on receipt and report any damage to us within 48 hours, with photos.
8. Right of withdrawal
You have 14 days from receipt of the piece to withdraw from the sale, without giving a reason, by writing to contact@dilipjindal.com (or using the form in the appendix). You then send the piece back within 14 days of your notice, unworn, in its original box, by a tracked and insured service. Return shipping is at your expense. We refund the full amount paid, standard delivery included, no later than 14 days after receiving the piece or proof of its dispatch, to the payment method you used. The right of withdrawal does not apply to pieces made to your specifications or clearly personalised (a ring resized for you, an engraving, a special order), in accordance with article L221-28 of the French Consumer Code. Full details are in our return and refund policy.
9. Statutory warranties
Independently of the right of withdrawal, you benefit from the statutory warranty of conformity (articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). To make a claim, write to contact@dilipjindal.com.
10. Intellectual property
The designs, photographs, texts and logo on this site belong to DILIP JINDAL PARIS. Any reproduction or use without written permission is prohibited.
11. Personal data
The data collected when you order is needed to process and deliver it. How we handle it is described in our privacy policy. You may exercise your rights by writing to contact@dilipjindal.com.
12. Mediation and disputes
If you have a complaint, write to us first at contact@dilipjindal.com: we always look for an amicable solution. Failing that, you may refer the dispute free of charge to the consumer mediator: being appointed; details available on request at contact@dilipjindal.com, under articles L611-1 et seq. of the French Consumer Code, or to the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr.
13. Governing law
These terms are governed by French law. In case of translation, the French version prevails. Disputes fall under the jurisdiction of the competent French courts, without prejudice to the mandatory consumer-protection rules of your country of residence.
